Welcome to Kākā Math ("the Service"), a personalised mathematics learning platform operated by Kākā Math ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use the Service. If you are a parent or guardian creating an account on behalf of a child, you accept these Terms on their behalf.

2. Service Description

Kākā Math provides a personalised maths learning experience for New Zealand students from Year 1 to Year 13. The Service includes:

  • Interactive lessons aligned to the New Zealand Mathematics curriculum
  • Cheeky Check: AI-powered analysis of handwritten maths work
  • Progressive hint system using the Socratic method
  • Gamification features including Feathers, Altitude, and badges
  • Parent dashboard for tracking student progress

3. Account Terms

To use the Service, a parent or guardian must create an account ("Parent Account"). You are responsible for:

  • Providing accurate and complete information during registration
  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Ensuring that child accounts are created and managed by a parent or legal guardian

You must be at least 18 years old to create a Parent Account. Child accounts can only be created by the parent or guardian who holds the Parent Account.

4. Acceptable Use

You agree to use the Service only for its intended purpose of mathematics learning and education. You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Upload content that is harmful, offensive, or inappropriate
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Cheeky Check feature for purposes other than analysing mathematical work
  • Reverse engineer or attempt to extract the source code of the Service

5. Content and Intellectual Property

All content within the Service -- including lessons, questions, images, the Kākā mascot and its variations, text, and software -- is owned by Kākā Math or its licensors and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from any content within the Service without our prior written consent.

Content uploaded by users (such as photos submitted to Cheeky Check) remains the property of the user. By uploading content, you grant us a limited licence to process it for the purpose of providing the Service.

6. AI-Generated Content

The Service uses artificial intelligence to generate personalised curricula, hints, and analysis of student work. While we strive for accuracy, AI-generated content may occasionally contain errors. The Service is intended to supplement, not replace, classroom instruction and teacher guidance.

7. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms.

8. Subscriptions and Payments

Certain features of the Service may require a paid subscription. Subscription terms, pricing, and payment details are presented within the app at the time of purchase. Subscriptions are managed through the Apple App Store and are subject to Apple's terms and conditions.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, Kākā Math shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

Kākā Math is an educational tool designed to support mathematics learning. It is not a substitute for professional teaching, tutoring, or educational assessment. Academic results may vary. We make no guarantees regarding specific educational outcomes.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Termination

You may stop using the Service at any time by deleting your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in behaviour that is harmful to other users or the Service.

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.
